Après les rejets français et néerlandais, le traité constitutionnel européen n’a pu être appliqué comme prévu au 1er novembre 2006. Après une période de réflexion, la Conférence intergouvernementale de l’été 2007 négocie le traité de Lisbonne, qui reprend largement le contenu du traité constitutionnel. Le traité de Lisbonne doit être ratifié par l’ensemble des États membres selon leurs procédures constitutionnelles respectives. Aucun des pays de l’Union ne soumet le traité au référendum à l’exception de l’Irlande. En juin 2007, alors que 18 pays ont déjà terminé leur procédure de ratification parlementaire, une majorité d’Irlandais rejette le traité de Lisbonne. Le traité aurait dû être appliqué le 1er janvier 2009. En attendant les résultats d’un second référendum en Irlande, il est en tout cas certain que le traité n’entrera pas en vigueur avant les élections européennes de juin 2009. Le Conseil européen de décembre 2008 a paré au plus pressé. Ces élections seront organisées sur la base du traité de Nice. La désignation du président de la Commission européenne par le Conseil européen après les élections est un enjeu de ces élections. Les partis politiques seront-ils capables de désigner un candidat suffisamment consensuel pouvant être avalisé par le Conseil européen ? Pourront-ils se doter de programmes politiques européens permettant une confrontation au niveau national ? Ces enjeux induisent aussi des recompositions au sein des principaux groupes politiques du Parlement européen.
