Abstract
Dans le cadre de cet article, nous proposons d’analyser les mutations pénales à partir d’un aspect plus particulier qui est celui de la finalité thérapeutique attribuée à certaines pratiques pénales. Nous tenterons de mieux cerner ce champ particulier de la pénalité en utilisant le concept de dispositif thérapeutique, ce qui nous permet d’approfondir ce champ comme étant constitué d’un ensemble d’éléments intimement liés qui gravitent tous autour de cette finalité de transformation des délinquants. Notre hypothèse de départ suggère que l’intervention thérapeutique s’articulerait depuis quelques décennies selon des nouvelles modalités. Nous évaluerons l’incidence de l’avènement de la nouvelle pénologie sur l’éventuelle réorganisation du dispositif thérapeutique de la fin du XX e siècle. Nous scruterons aussi trois manifestations plus précises de ces transformations que sont la révolution cognitive dans le champ de l’intervention clinique, la multiplication des outils actuariels d’évaluation clinique et la responsabilisation accrue des bénéficiaires de l’intervention thérapeutique. Nous terminerons en abordant un enjeu qui nous apparaît fondamental dans le cadre de ces transformations, soit celui de la tendance au morcellement de l’individu qui se trouve au coeur de ce dispositif thérapeutique.
