Cet article porte sur la modification de l’état civil des enfants adoptés en tant que manifestation du pouvoir de l’État et du droit de définir l’identité civile des individus, leur parenté et leur citoyenneté. Il établit les liens entre les problématiques de la filiation, de la citoyenneté et de l’état civil. Il examine comment l’acte de naissance produit après une adoption plénière légitime un effacement des origines qui peut entrer en porte-à-faux avec la réalité subjective des adoptés, mais qui est souvent contredit par les traces documentaires créées au cours du processus d’adoption internationale. En conclusion, il discute de l’ouverture du droit à une approche juridique de l’adoption qui ne se fonderait plus sur la fiction d’une re-naissance de l’enfant concerné.
