Abstract
Cet article traite du mythe du « Chinois non revendicateur » dans le contexte des réformes chinoises amorcées en 1978. Selon le gouvernement chinois, les droits de la personne peuvent être interprétés de manière variable en fonction du contexte national et le rapport au droit des justiciables chinois serait régi par une supposée préférence culturelle pour l’harmonie. Or, les justiciables chinois n’hésitent pas à saisir les tribunaux afin de faire valoir leurs droits, réduisant à néant l’argument voulant qu’ils soient prêts à sacrifier leurs droits afin de préserver l’harmonie. En outre, de nombreux justiciables et acteurs sociaux revendiquent, implicitement ou non, une position fondée sur le caractère universel des droits. Il y a donc rupture entre les représentations officielles et la pratique des acteurs.
