L’intensification du travail et l’évolution des relations de travail ont engendré des risques nouveaux en ce qu’ils n’étaient pas encore sérieusement pris en considération. L’évolution du travail a fait que désormais ils deviennent incontournables. Outre les risques liés à l’entreprise, à l’emploi, au capital humain, en matière de santé au travail la santé mentale des travailleurs est davantage éprouvée qu’auparavant. Le coût financier et humain, mais aussi certaines atteintes à la dignité au travail, font que la mise en jeu de la santé mentale des travailleurs devient un enjeu concernant notamment le droit du travail. Il s’agira ainsi d’envisager comment celui-ci prend en compte la santé mentale des travailleurs à travers les risques psychosociaux, le harcèlement moral et le stress au travail, mais aussi les institutions de prévention des risques professionnels et les autres acteurs de l’entreprise.
