Abstract
La hausse de l’âge du consentement sexuel a été présentée comme une mesure de protection des jeunes. Pourtant, ceux-ci étaient déjà protégés contre les abus et l’exploitation sexuels. L’effet concret de la modification législative est ailleurs : désormais, les contacts sexuels consentis entre adultes et adolescents sont interdits. Or les données publiées sur le sujet démontrent que les jeunes ont une vie sexuelle active et que leurs relations intimes avec des adultes, dans un contexte de relative égalité, peuvent s’avérer positives. La criminalisation de la sexualité adolescente est un risque réel. La hausse de l’âge du consentement permet toutefois au législateur d’affirmer à peu de frais une action politique contre les « prédateurs sexuels ». Selon les auteures, cette action s’inscrit clairement dans une perspective populiste.
