Dans notre contribution, nous voudrions aborder les pratiques du pardonner en relation avec les pratiques institutionnelles et juridiques de l’amnistie. À ce propos, nous distinguerons le jugement éthique du jugement moral afin de lier le discours sur la subjectivité au discours sur les domaines culturels, tels le droit et la juridiction. En effet, la dimension éthique est suspendue entre l’institutionnalisation des valeurs (protocole, procédure, loi) et l’autoréglage du sujet agent (pratiques d’autoréflexion et gestion de soi-même) : dans la dimension éthique, le sens reste toujours questionnable. L’imperfectivité de la clôture sémantique (le « pourquoi » de l’action) entraîne pour toute pratique éthique la nécessité de se « justifier » et, surtout, le devoir de rendre compte de son fondement dans la durée. Tout cela met au coeur de l’éthique des pratiques la décision , c’est-à-dire une négociation de la pratique sur son propre bien-fondé, son « caractère sensé », dans une tension interprétative qui connecte la motivation à la loi. Enfin, nous pointerons du doigt le fait que, dans le régime de l’éthique, existe un fort besoin de reconnaissance réciproque, telle la reconnaissance réciproque et publique de la culpabilité et du pardon. La relation entre victime et coupable ne touche pas seulement à la relation intime entre les deux, ni seulement aux pratiques de sanctions juridiques, mais aussi aux jugements de l’opinion publique, voire de la doxa , car c’est cette dernière qui encadre la relation et construit les frontières entre le pardonnable et l’impardonnable.
