On June 6th, 2013, in JTI Macdonald TM Corp v. Imperial Tobacco Products Limited, 2013 FC 608, Canada’s Federal Court dismissed an appeal by JTI Macdonald TM Corp (“JTI”), who opposed two trademarks filed by Imperial Tobacco Products Limited (“Imperial Tobacco”) for the colour orange as applied to cigarette packages.
