Abstract
À l’aide de l’exemple de la législation portant sur les soins de longue durée, l’auteur démontre comment le législateur de la Communauté flamande a tenté avec succès d’interpréter le texte de la Constitution belge en sa faveur. La compétence ainsi acquise, conduisant à une législation réservée aux seuls résidants de la Flandre, risque pourtant d’être considérée comme portant atteinte au principe communautaire fondamental de la libre circulation des personnes. On voit comment peu apparaître une nouvelle législation sociale subétatique qui ne peut s’abstraire d’une mise en conformité avec le droit supranational européen.
