Abstract
L’objet de cet article est d’analyser les formes de contrôle social dans une institution carcérale considérée aujourd’hui par plusieurs auteurs comme une institution ouverte. À partir d’entrevues qualitatives menées en 2003 auprès de trente-six hommes incarcérés dans trois pénitenciers canadiens, nous avons exploré leurs expériences en milieu pénitentiaire. Il ressort de notre étude qu’à l’heure actuelle, les personnes détenues, en dépit d’un cadre normatif formel de reconnaissance et de protection de leurs droits, font encore et toujours l’objet d’un pouvoir dissymétrique. Le modèle canadien, en recourant à des grilles d’évaluation actuarielles et en attribuant à « l’expert» un pouvoir d’interprétation de leur cas comme des moyens d’investigation conséquents, conduit les détenus à se retrouver soumis à une perception négative, stéréotypée et peu valorisante de leur dossier. Dans ce cadre, le « bon comportement» institutionnel semble être la stratégie la plus efficace pour obtenir une libération anticipée. Centré sur un managérialisme efficace, le contrôle exercé sur eux a alors pris une force majeure.
