Abstract
Le texte de la Constitution française de 1958 ne recèle ni garantie de « droits fondamentaux », ni énoncé normatif traitant en substance du travail salarié. Mais les différentes branches de l’ordre juridique de la République ont été affectées par un processus jurisprudentiel de constitutionnalisation à deux composantes : la mise en évidence d’un « bloc de constitutionnalité » débordant le seul texte de la Constitution et l’affirmation de son emprise sur l’ensemble des rapports juridiques, y compris des rapports privés. Le dessin des bases constitutionnelles du droit du travail est, pour l’essentiel, à porter au crédit du Conseil constitutionnel, dont les décisions manifestent l’incidence complexe de ces normes supérieures sur la législation du travail. Cette autre action des normes constitutionnelles qu’est l’appréhension des relations du travail elles-mêmes apparaît dans des décisions des juridictions judiciaires, en particulier dans des arrêts de la Cour de cassation.
