Depuis leur émergence en droit, les notions de patrimoine culturel et d'authenticité ont beaucoup évolué. Cette double révolution conceptuelle ne révèle pas seulement la nécessité de protection et de conservation d'une grande variété des objets. Elle permet aussi de saisir une possibilité de changement en faisant référence aux droits culturels.L’objectif de cet article est de démontrer qu’il existe un déficit de légitimité en matière de gestion du patrimoine culturel et que celui-ci tend à être rempli à travers les droits de l'homme. Ce déficit de légitimité a été dissimulé de deux manières. D’abord au niveau national où le patrimoine culturel est utilisé pour exalter un sentiment d’appartenance à une nation et à son identité culturelle. Ensuite, au niveau international où le patrimoine culturel est rattaché aux valeurs cosmopolites, notamment à l’authenticité de l’œuvre d’art et aux valeurs universelles esthétiques qui sont décidées par une élite. Mais dans la société contemporaine les individus tendent à développer des appartenances et des identités culturelles multiples et flexibles. Dans ce cadre les individus ainsi que les groupes mécontents revendiquent une nouvelle forme de légitimité à travers un droit au patrimoine culturel de leur choix.
