Abstract
Cet article a pour but de vérifier les conditions d'application de l'article 45 du Code du travail dans les situations de sous-traitance depuis l'arrêt du 22 décembre 1988 de la Cour suprême dans l'affaire C.S.R.O . À cette fin, l'auteur examine de manière systématique la jurisprudence postérieure à l'arrêt de la Cour suprême. En matière de sous-traitance simple, l'arrêt C.S.R.O . ne modifie pas l'application de l'article 45 lorsque l'activité du sous-traitant s'intègre à l'activité du donneur d'ouvrage. Toutefois, lors de sous-traitance extérieure, l'application de l'article 45 est maintenant conditionnelle au transfert des moyens de base permettant la production du bien ou du service recherché. Enfin, lors d'un changement de sous-traitants — la sous-traitance successive — l'auteur constate que l'exigence d'un lien de droit entre le nouvel employeur et l'employeur précédent, exigence formulée par l'arrêt C.S.R.O ., doit être limitée, selon la jurisprudence du Tribunal du travail, aux seules situations où le syndicat était accrédité à l'origine auprès du premier sous-traitant.
