Abstract
Cet article porte sur le projet controversé d’introduire une forme d’adoption additive dans le Code civil du Québec . Après avoir constaté les limites du droit québécois, aujourd’hui confronté à diverses configurations familiales qui s’écartent du modèle conjugal traditionnel, les auteures examinent trois propositions de lois (présentées en 2007, 2012 et 2013) qui ont jalonné le processus de réforme de l’adoption amorcé en 2006. L’article vise à démontrer que d’une proposition à l’autre, les motifs justifiant de préserver la filiation d’origine de certains enfants adoptés semblent avoir été oubliés ou écartés. En effet, dans la recherche de l’intérêt de l’enfant adopté, l’enjeu identitaire prévaudrait désormais sur celui de ses liens d’appartenance familiale. Ce parcours analytique met en lumière la résistance du législateur à reconnaître la pluriparenté, même lorsqu’elle existe déjà dans les faits. Il démontre également qu’au-delà d’une réforme de l’adoption, c’est toute la filiation qui fait actuellement l’objet d’un travail implicite de redéfinition.
