L’important potentiel thérapeutique que laissent miroiter les cellules souches embryonnaires humaines conduit actuellement de nombreux pays à revoir l’adéquation de leur encadrement juridique concernant la recherche sur l’embryon et ses cellules. Au-delà de la question de l’opportunité de légaliser ou non ces recherches, l’étude des règles substantives en la matière révèle au niveau international l’apparition d’une relative convergence des conditions de recherche sur l’embryon et les cellules souches embryonnaires. À cette convergence s’associe pourtant une grande variété de modèles de réglementation retenus ou envisagés. L’auteure s’interroge ici sur l’impact des mécanismes juridiques choisis pour encadrer la recherche sur l’embryon et les cellules souches embryonnaires et évalue leurs qualités respectives en fonction des attentes partagées par les acteurs visés. Son analyse apporte notamment des éléments de réflexion critique quant au recours à une agence de réglementation, retenu dans la récente loi canadienne et préconisé en France, pour régir ces champs de recherche qui touchent notre rapport au symbolique.
