Abstract
This chapter explores the invasion of the fiduciary concept into the common law of obligations, particularly in Canadian and Australian law. It considers the motivations for resorting to fiduciary arguments, and analyses how to detect a fiduciary obligation in a relationship which is not ordinarily characterised as being such. It evaluates the fiduciary phenomenon as pleaded in the context of advisory relationships and compares the remedies available in tort and breach of fiduciary duty. It then examines the use of fiduciary arguments in the sexual exploitation of dependency relationships, such as a professional and patient, and adult and child.
