Abstract
L’article présente les résultats d’une recherche sur les conflits environnementaux repérés devant les tribunaux judiciaires d’un département français. L’analyse des affaires jugées en 2006 montre que le contentieux judiciaire (pénal et civil) ne représente qu’environ 5% de toutes les affaires. Au civil, il s’agit essentiellement de problèmes de droit de propriété entre particuliers. Les juges émettent des injonctions à rétablir un droit et recourent peu à la réparation monétaire. Au pénal, les affaires de bruit et de chasse dominent. La sanction relève en majorité de l’amende et dans 20% des cas à une peine privative de liberté. La réparation civile est peu fréquente du fait de l’absence de parties civiles, comme si l’environnement n’avait pas toujours de porte-parole. Le juge pénal n’apparaît pas comme un acteur majeur de la redistribution des droits d’usage des ressources environnementales.
