Choisir ses héritiers. Recompositions familiales et successions patrimoniales en France et au Québec Cet article aborde sous l’angle de l’ethnologie de la parenté les normes juridiques et les usages sociaux de la transmission des biens dans les familles recomposées françaises et québécoises. Il examine les possibilités de reconnaissance juridique des liens électifs et pluriels nés dans les familles recomposées, et les confronte aux usages de la succession au sein des familles françaises et québécoises, à travers les résultats d’une enquête menée en France au début des années 2000 au sein de familles recomposées, et d’une recherche menée à Montréal en 2006 dans plusieurs études notariales. En dépit de la liberté testamentaire régnant au Québec, qui tranche avec le caractère plus contraignant de la législation française, les usages dessinent une valorisation comparable de la transmission des biens comme support de continuation de la personne au sein de sa parenté. Mais la transmission se limite le plus souvent au second conjoint et aux descendants biologiques et légaux. Les beaux-enfants et les relations « choisies » nées des recompositions familiales y sont rarement représentés. Lorsque c’est le cas, c’est la dimension éducative des relations et le souci d’égalité entre « frères et soeurs » qui fonde leur reconnaissance à travers la succession. La législation québécoise, plus ouverte, permet pour sa part à ces relations choisies de s’incarner plus aisément dans la transmission des biens.
