The pace of development in the field of investment/environment disputes did not abate in 2010. Disputes related to extractive industries dominated the scene, but arbitration also branched into new areas with cases emerging on wildlife management and failed emissions reduction projects. While Canada continued to be the most frequent respondent in environmentally related investor-state disputes, more than half of the cases ongoing in 2010 involved developing countries. Several of the cases reported on in last year’s volume of the Yearbook are not followed up on in this report either because there have been no developments of particular note (Dow Chemical v Canada, Bilcon/Claytons v Canada, Peter A Allard v Barbados, Abengoa, SA v United Mexican States) or because there is simply too little information publicly available to write anything of substance (Reinhard Hans Unglaube v Republic of Costa Rica, Gold Reserve v Venezuela).
