L'absence de reconnaissance institutionnelle des religions ainsi que l'affirmation de neutralité religieuse de l'État imposent à ce dernier de les traiter toutes de manière égale, sans en privilégier ni en défavoriser aucune. Posées dans le cadre français, ces règles simples dans leur principe soulèvent en droit de nombreuses difficultés. En effet, les solutions juridiques mises en oeuvre pour aménager l'exercice de la liberté religieuse créent parfois des discriminations au désavantage de certains cultes. Pour des raisons notamment de tradition historique, la place du catholicisme est à certains égards favorisée, au détriment en particulier des religions dites minoritaires ou encore d'implantation plus récente. La première partie de l'exposé, établit un bilan du droit français actuel et il met ainsi en évidence trois causes de discrimination : l'imprégnation chrétienne du droit laïque, la loi de 1905 portant séparation de l'Église et de l'État elle-même et, enfin, les motifs d'ordre public, opposés à des religions comptant peu d'adeptes, au nom de la lutte contre les sectes. La seconde partie, cherche à proposer les conditions d'un traitement non discriminatoire des religions. Cela implique notamment de tenir compte de leurs spécificités et de renoncer lorsque le traitement est inadapté à un régime uniforme au profit d'aménagements particuliers. Le droit français s'est déjà engagé, au reste, dans cette voie.
