Cet article, issu d’une étude qualitative menée dans une maison d’arrêt en France, propose d’analyser et de décrire les formes d’inégalités, de discrimination et de privilèges sur lesquels se fonde l’ordre en détention. Sur la base d’une discussion de différents problèmes théoriques soulevés par l’analyse de la complexité des relations surveillants-détenus, du poids des contraintes sécuritaires sur l’ensemble des logiques d’action, ou encore des jeux d’identités et d’identifications en détention, nous décrivons trois types de position occupées par les détenus : d’abord le « stratège » qui développe un véritable contre-pouvoir tout en participant activement au contrôle des autres détenus ; ensuite le « tacticien » qui, au jour le jour, ruse pour améliorer son quotidien ; enfin, le « soumis » qui est l’objet de persécutions et de formes d’oppression spécifiques. À travers la description de cette structure de domination, nous montrons que l’institution ne vise pas tant à dépersonnaliser les détenus pour fonder de nouvelles identités conformes à l’institution qu’à s’appuyer plus pragmatiquement sur les capacités différentielles d’initiative et les inégalités sociales en détention pour minimiser les sources de désordre.In fine, ce constat nous conduit à proposer une redéfinition partielle du concept d’institution totale.
