Abstract
L’exploitation des ressources naturelles connaît un important regain d’intérêt dans l’arène internationale. Les impacts engendrés par les activités privées des entreprises transnationales sur les communautés locales autochtones sont à l’origine de tensions entre les communautés, les compagnies extractives et l’État. De manière croissante, le droit au consentement libre, préalable et informé (CLPI) est considéré comme un moyen d’inclure significativement les communautés dans les processus décisionnels, de manière à contribuer à la mitigation des impacts socio-économiques et environnementaux du développement lié aux ressources naturelles. Le principe de CLPI jouit d’une reconnaissance grandissante et d’une intégration accrue dans le corpus de normes, tant au niveau national qu’international. Aucune définition universelle de ce principe n’ayant été élaborée à ce jour, plusieurs questions demeurent néanmoins au regard de la nature et du contenu du CLPI. Cet article vise à explorer la notion de CLPI et à mettre en lumière comment cette notion a été élaborée et intégrée dans le droit international.
