Abstract
La tesis de este trabajo es que la función económica básica del derecho es definir el sistema económico que rige en la sociedad y organizar el funcionamiento de dicho sistema. Bajo esta perspectiva, el análisis económico del derecho consiste en el estudio y la evaluación de las normas jurídicas desde el punto de vista de sus funciones económicas, lo que permite clasificar a éstas según el tipo de régimen económico que ayuden a organizar, y a las ramas de la economía según el tipo de normas que estudien. También permite reconocer que casi todo el análisis económico mezcla elementos de análisis económico del derecho con otros destinados a analizar el entorno y las conductas de los agentes económicos. Desde el punto de vista de su relación con la teoría jurídica, esta manera de visualizar económicamente el derecho puede ser compatible con el positivismo, el iusnaturalismo y el realismo. Esta compatibilización se logra mediante una reformulación de los objetivos del análisis económico del derecho, que excluye el llamado análisis positivo de las estructuras jurídicas, pero incluye la consideración de problemas de equidad impersonal e interpersonal.
