Abstract
En matière de bioéthique, la loi se caractérise par une évolutivité justifiée par le progrès scientifique. La question des recherches sur l’embryon semble aujourd’hui révéler l’hypothèse d’une science dépassée par ses promesses et risquant d’être rattrapée par la loi. La congélation d’embryons humains a conduit à la constitution d’un stock ayant suscité l’intérêt de ceux qui désiraient les utiliser expérimentalement. En France, la loi a interdit ces recherches en 1994. En 2004, le législateur a ouvert une possibilité exceptionnelle : ces recherches peuvent être autorisées si elles poursuivent des progrès thérapeutiques majeurs ne pouvant être atteints par des méthodes alternatives. Ce régime a été conçu pour permettre aux chercheurs de tenir les promesses faites depuis 1994 : trouver une solution aux maladies incurables. À l’heure de la seconde révision, ces espoirs semblent plus que mesurés et des recherches alternatives, menées sur ces cellules souches adultes, font la preuve de leur efficacité. Paradoxalement, c’est désormais la science qui est en retard sur la loi.
