Abstract
Les codes civils présentent des zones de résistance et de fragilité et les normes elles-mêmes sont résistantes ou fragiles selon les circonstances, les interprétations et les débats qui les entourent. L’évolution du Code civil du Québec pendant la dernière décennie offre de nombreux exemples d’évolution des normes qui tient pour partie à la résistance de celles-ci ou à leur fragilité par rapport aux besoins exprimés par les citoyens, aux interprétations des tribunaux ou à la pratique professionnelle. Par ailleurs, les changements normatifs étant inévitables, une partie de la réflexion de l’auteure porte aussi sur le modèle que la communauté juridique peut offrir en appui aux changements.
