Abstract
L’ouverture des services publics à la concurrence et la régulation sont un bouleversement des missions traditionnelles de l’État et modifient de façon profonde les relations entre la puissance publique et la société. Dans ce contexte, de nouvelles méthodes de gestion sont mises en place, notamment au bénéfice des usagers-consommateurs. Cependant, les lacunes constatées dans le contrôle démocratique des autorités de régulation sont compensées par l’extension de leurs compétences, qui comprend désormais la défense des intérêts des individus. Ainsi, la participation et le contrôle du peuple ou de ses représentants, en ce qui concerne les activités et décisions des autorités de régulation, sont remplacés par des activités et décisions en faveur des représentés, les usagers-consommateurs. L’enjeu démocratique de la régulation passe du contrôle de ces autorités à leur capacité de défendre les intérêts des individus.
