Abstract
Dans sa lutte contre les discriminations, le Canada s’est doté de mécanismes juridiques pour prévenir ou résoudre les conflits entre normes religieuses et normes civiles. L’obligation d’accommodement raisonnable est l’un de ces mécanismes qui visent à prendre des mesures raisonnables pour respecter les besoins spécifiques qui différencient certaines personnes de la majorité, et ce, afin de protéger leur droit à l’égalité. Il répond donc à un objectif d’intégration des minorités. Toutefois, accorder un traitement particulier à des membres de minorités n’équivaut pas à créer une justice particulière. Les aménagements d’une norme, par l’ajout d’exceptions ou de dérogations, ne créent pas une norme distincte. La création de règles dérogatoires dépend elle-même de leur conformité aux règles de droit de la majorité. Par conséquent, cette conception de l’accommodement ne permet guère de redéfinir les règles du vivre ensemble. Adapter les normes suffit-il à une société pour qu’elle s’adapte au pluralisme ?
