Abstract
This article examines the policy questions facing C anada in deciding whether and how to implement the UNCITRAL Electronic Communications Convention. It explains the nature of treaty implementation in Canada's federal system. It revie ws expert opinions on whether the Convention was compatible with Canada's civil law and common law systems. It then discusses the policy issues considered by the Uniform Law Conference of Canada in preparing model legislation to implement the Convention. These issues include the scope of the C onvention, whether it should apply to other conventions to which Canada is a party, whether domestic law should be made to conform to the Convention, what exclusions or permissions should be applied compared to Canadian domestic law, and similar matters. The paper records the conclusi ons of the Conference on each question but also notes that there has been little legal, academic or political support for the Convention in recent yea rs.
