Abstract
La Loi québécoise sur le lobbyisme possède un statut spécial dans l’ordonnancement juridique parce qu’elle donne effet à des droits qui sont protégés aux niveaux constitutionnel et quasi constitutionnel (le droit à l’information, la liberté d’expression et le droit de voter aux élections) et parce qu’elle met en œuvre des principes structurels de la Constitution (la démocratie et le gouvernement responsable). En dépit du fait qu’elle ne soit pas elle-même supralégislative, la Loi sur le lobbyisme doit recevoir une interprétation large et généreuse et pouvoir ainsi résister aux attaques qui seraient fondées sur d’autres droits fondamentaux que celui qu’elle promeut : le droit du public de savoir qui cherche à influencer le gouvernement.
