Abstract
On a parfois avancé que le cas des tribunaux religieux en droit de la famille mettait à l’épreuve les limites du multiculturalisme libéral canadien. Cette idée est sans doute erronée. Cet article rappelle, dans ce sens, que la conception canadienne du multiculturalisme est une conception libérale : elle repose sur la valeur de la liberté individuelle, limitée par les droits individuels de base et fondée sur l’espoir et l’attente que d’accorder aux nouveaux arrivants l’accès aux bénéfices du multiculturalisme facilitera leur intégration sociale et politique. Cet espoir et cette attente sont actuellement remis en question dans le cas des nouveaux arrivants musulmans, dont on craint qu’ils cherchent à utiliser le multiculturalisme de manière antilibérale pour limiter les droits individuels. Les tribunaux de la « charia » en Ontario ont été considérés comme une confirmation de cette crainte. Or les demandes de tribunaux islamiques ne se sont pas fondées sur la Loi sur le multiculturalisme canadien, mais sur l’arbitrage privé en droit de la famille.
