Abstract
This article outlines the argument that the legitimacy of the law of the Constitution of Canada requires the consent of the Aboriginal or indigenous1 peoples and that Canada has a positive duty to negotiate constitutional agreements with indigenous peoples in certain circumstances. The argument draws upon fundamental unwritten principles of the Constitution that have been elaborated by the courts and also upon express constitutional provisions. It also draws upon precepts from international law.
