Abstract
Les poursuites à l’encontre de dirigeants en exercice pour des crimes de guerre et contre l’humanité devant leurs propres tribunaux sont rares pour ne pas dire inexistantes, ce qui accrédite l’opinion qu’ils bénéficient d’une totale impunité. Depuis l’entrée en vigueur du Statut de Rome instituant une Cour pénale internationale (CPI), la qualité de chef d’État n’empêche en aucun cas la responsabilité pénale pour des crimes internationaux. Mais comme la CPI peut seulement exercer sa compétence de façon complémentaire aux juridictions nationales, la question se pose alors de savoir si les juridictions nationales sont en mesure de poursuivre des chefs d’État en exercice dans la mesure où ils sont présumés responsables des crimes relevant de la compétence de la CPI.
