A literatura de Franz Kafka coloca o homem diante de um aparato de controle, sempre remetendo às burocracias e impedimentos criados pelo Estado, apoiado no direito. Um emaranhado de instâncias nas quais a acessibilidade do homem comum parece inalcançável. O direito parece responder com suposta facilidade e objetividade, o que pode ser entendido por “homem comum” enquanto “sujeito de direito”. A parábola “Diante da Lei”, contida no livro “O Processo” de Kafka, parece ilustrar acuradamente a relação do sujeito de direito com o soberano. Os discursos jurídicos e morais são contornos tangíveis ao sujeito que é o motor e o símbolo da modernidade, sua existência se produzirá perante a lei. Para universalizar seu discurso utiliza tecnologias, tal qual a Constituição. Nela sempre existem normas programáticas, nas quais as demandas serão sempre administradas para o futuro e este nunca é determinado. Neste momento o Estado adquire a possibilidade de se reavivar e autodeterminar constantemente. Ao mesmo tempo o sujeito parece esquecido e vítima de articulações de interesses políticos e, muitas vezes, particulares. Na signifi cação da palavra sujeito é como se ele sofresse de esquizofrenia intrínseca, o sujeito será o subjectum e em outrora o subjectus, ou seja, a dupla paradoxal entre o criador e o criado da lei.
