Este artigo objetiva analisar a ilegitimidade do método processual previsto no Estatuto da Criança e do Adoles­cente para colheita de prova oral em processo de apuração de ato infracional. Por meio de um sistema dedutivo, almeja­-se evidenciar a possibilidade de apresentação do adolescente e oitivas de testemunhas em audiência una, tal como conven­cionado atualmente à esfera criminal. Para tanto, inicial­mente, evidenciou-se, frente o princípio da economia proces­sual, a relevância de um procedi­mento ágil. Ainda, questionou-se se o sistema da Lei n°8.069/90, ao cindir atos de instrução, evita a excessiva duração da instrução probatória e cumpre, da maneira mais célere, os prazos proces­suais exigidos naquela Lei. Abor­daram-se também os princípios da oralidade e da concentração no processamento de represen­tação em face de adolescente, bem como foram avaliadas suas consequências. Referida avaliação conectou-se direta­mente ao princípio da presunção de inocência diante da frequente assunção de culpa pelo adoles­cente na apuração de ato infracional. Ao fim, concluiu-se pela ilegitimidade do desmem­bramento para colheita de prova oral no processamento de apuração de ato infracional, revelando-se a necessidade de audiência una.
