Abstract
This paper aims to propose the implementation of Mediation in juvenile offenders in our country. For diffusion suggested the implementation of projects and campaigns from schools, public, private and media general, making known the benefits of this method of solution conflicts. The research takes the view that the first legislation that recognized the mediation in criminal cases are: Spain, United States, Brazil and now, modern laws Oceania, Europe and North America as New Zealand, Australia, Canada, Spain, Norway, France, Germany apply it, in Latin America, sorne countries are trying to promote projects for the implementation of Mediation and these are: Bolivia, Panama, Ecuador, Mexico, Chile, Colombia, Guatemala, Peru, Argentina. As for the doctrine, most of treatises agree that you must implement penal mediation as an alternative mechanism for resolving conflicts, while a minority has differences, because they consider it better develop prevention of juvenile delinquency. After research leads to further establish that the offenses acting common in adolescents are: theft, robbery, sale and drug use, rape, offenses that are punishable by detention centers for juvenile offenders, in which remain a certain time depending on the offense or crime committed, which may be days, months or years. Is needed in this work that is not possible to use mediation to resoJve all offenses committed by adolescents. It states that Mediation can be applied to matters for which by their nature can compromise, as currently being used in for criminal offenses or converted private action in which compensation arrangements fit with the intervention of mediators, no However, there are implemented in terms of violations adolescents, it was concluded by suggesting its application legal reform to enable mediation in certain offenses cornmitted by teenagers, to avoid institutionalization that instead of rehabilitating causes increase in crime.
