Abstract
This preparation examines Harvard's patent application for its transgenic non-human mammal (the Harvard oncomouse) across the trinity of Canada, the US and Europe. Almost painfully simple in its drafting and construction (spanning no more than a couple dozen pages). Harvard's application challenged traditional notions of patentable art and subject matter, with its judicial treatment here in Canada remaining particularly salient and insightful, offering an eclectic sampling of the policy considerations which the field of biotechnology as a whole presents for Patent practitioners and academics alike. Indeed, it remains a curious feature of the jurisprudence and literature that Harvard's oncomouse per se has been afforded a patent monopoly in all of the aforestated territories, with the notable exception of Canada. As such, principal elements of this paper will be devoted to a measured comparison of Harvard's patent application(s) for their oncomouse across Europe, Canada and the United States. Primary authority shall be gleaned from the patent documents themselves, with secondary material drawn from the stock of much of the opposition proceedings which have been undertaken in response to such.
