Abstract
Alors que l’esclave est l’incarnation du non-droit, les sociétés humaines n’ont de tout temps cessé de légiférer à son égard. Si à partir des abolitions (avec quelques coupures ...), un grand nombre d’instruments, multilatéraux et bilatéraux, renferment des dispositions qui interdisent l’esclavage en temps de guerre comme en temps de paix et font évoluer l’interdit d’exercer sur autrui un droit de propriété à la référence à des situations contraires à la dignité humaine – élevant un crime contre l’humanité, le Droit n’a cessé de tenter de résoudre les contradictions qui naissaient de sa confrontation au système social. Il y a donc un statut juridique de l’esclave défini par l’interdit que nous tentons ici d’analyser au travers d’une perspective juridique enracinée dans une approche critique du Droit où, en tant que rapport social, il est lié aux rapports de force et conflits d’intérêts mais aussi aux valeurs sociales qui sont au fondement des divers systèmes juridiques, avec les contradictions qui peuvent exister d’un domaine à l’autre. Sur cette base, c’est une réflexion qui se veut éclairante sur le sens du droit en matière d’esclavage que nous avons voulu mener, c’est-à-dire à la fois sa signification et la direction dans laquelle il oriente ou peut orienter la société qui a contribué à le créer.
