This article seeks to address the questions of whether, and, if so, to what extent, Canadian copyright jurisprudence protects submissions for television show or feature film concepts. In parallel to the experience in the United States, as the Canadian entertainment industry continues to mature and expand, courts are likely to be presented with an increasing number of disputes involving claimants alleging copyright infringement based on a show or movie which resembles (or copies) a proposal that the claimant had submitted to the producer. This article attempts to set forth the current state of Canadian law regarding such claims, and by reference thereto and to salient Commonwealth cases, provide guidance to those submitting proposals, those receiving proposals and those who may be asked to provide advice to either of those sides.
