This article will take a closer look at Canada’s pharmaceutical patent regime. We will examine the Government of Canada’s attempts to find a balance between effective patent protection for drugs, while providing access to cheaper generic drugs. We outline the history and current status of pharmaceutical regulation in Canada. In the particular, the enactment of the Patented Medicines (Notice of Compliance) Regulations is examined, along with Canada’s Patent Act, to determine whether the Canadian Government has been successful in achieving a balance between pharmaceutical patent protection and access to cheaper medicines. In the end, we offer some “modest proposals” to help the Canadian Government achieve the balance so longed-for.
