Abstract
This paper offers two recent regulatory rulings about competition issues that provide considerable insight on the future regulatory direction of the industry. While the focus of each case is different, both offer considerable evidence of market power abuse by the host railway. Two related explanations are proposed for the refusal of the regulatory agency to grant access in the cases. The paper then describes the economic principle of regulatory capture in the context of regulatory decisions. Also described is the mythology of Pandora's box in the context of the Canadian rail industry.
