Abstract
The article identifies and examines the various features of the equitable remedy developed in Canada, under which the Crown is held liable to indigenous peoples for acts and omissions in breach of a fiduciary duty. It argues that the Canadian remedy and the ideas on which it is based are largely applicable in the context of New Zealand law. It also evaluates the elements of the Crown/Maori relationship under which the remedy could be used and examines how lapse of time impacts the availability of the remedy.
