Abstract
Recent anti-zeroing decisions at the World Trade Organization have put the United States in a precarious legal position. Namely, can the U.S. retroactively calculate antidumping duties, originally calculated using zeroing, and recalculate them using WTO-consistent methods. This question coincides with a broader question of how to read Section 129(c)(1) of the Uruguay Round Agreements Act - the implementing legislation for the Uruguay Round - given that it has prospective effect only. The true nature of Section 129(c)(1) is debated, and has been at least since Canada challenged it at the WTO in 2002. This paper seeks to clarify whether the U.S. can retroactively calculate the antidumping duties at issue in the WTO's recent anti-zeroing cases, and in so doing, attempts to shed light on the true meaning of Section 129(c)(1).
