Abstract
The renewal of the 2006-07 European Union-Morocco Fisheries Partnership Agreement, which permitted fishing by European flag vessels in the waters of coastal Western Sahara, is considered in the context of current international humanitarian and criminal law. The particular question of the criminal liability of EU officials who would permit the resumption of the fishery, as a matter of the law of pillage including under the Rome Statute 1998 of the International Criminal Court and the Fourth Geneva Convention 1949 is addressed. It is concluded that individual criminal liability is possible if a renewal of the agreement extends to the coastal waters of occupied Western Sahara.
