Il sempre crescente numero di passeggeri che si avvale di trasporti operati da vettori low cost impone una riflessione sul rapporto tra la disciplina inerente al trasporto aereo di persone (Convenzione di Montreal del1999) e quella europea e italiana a protezione del consumatore. Inquadrato l'acquisto on line di un biglietto aereo nell'ambito dei contratti a distanza, occorre determinare la tutela da apprestarsi ad un acquirente «a distanza» che rivesta anche la posizione di «passeggero aereo». Lo scritto, dopo aver considera/o il quadro normativo di riferimento e la posizione del!a giurisprudenza amministrativa e de/la Corte di Giustizia, conclude affermando la necessita che regime inderogabile de/la responsabilita del vettore aereo e tutela del consumatore debbano essere due sistemi che (salvo eccezioni espresse) debbano trovare applicazione congiunta, ciascuno in relazione ai propri presupposti di applicazione e con le proprie specificita.
