Abstract
Formée tout à la fois en droit et en science politique, Andrée Lajoie manifeste dans l’ensemble de son œuvre une attention soutenue et singulière aux pouvoirs et aux rapports de pouvoir, et par conséquent aux jeux de pouvoir qui accompagnent aussi bien la production du droit que son instrumentalisation et les différents modes de mobilisation auxquels il se prête. Ses analyses empiriques des décisions de la Cour suprême du Canada, par exemple, mettent en lumière la puissance surdéterminante des idéologies dominantes, lorsque le tribunal doit prendre position dans des causes impliquant les droits de minorités, qu’il s’agisse des gais et lesbiennes, des Amérindiens canadiens, des femmes ou du Québec. L’intérêt qu’elle a porté aux problèmes de gouvernance dans les communautés autochtones du Québec surgissait d’une même perception de la fabrique sociale faite des déséquilibres et des disparités dans l’accès aux commandes décisionnelles dans ces sociétés, comme dans tout autre d’ailleurs.
