French Abstract: Depuis les annees 80-90 sous l’impulsion de developpements en matiere de biotechnologie, les activites de recherche sur la biodiversite et en particulier sur les ressources genetiques ont connu un essor important. Le developpement de ces activites a entraine l’elaboration de nouvelles regles au niveau international en matiere d’acces aux ressources genetiques et de partage des avantages decoulant de leur utilisation. Ces mesures concernent les communautes autochtones et locales au titre de fournisseurs de ressources mais aussi de savoirs traditionnels associes a ces ressources. La mise en œuvre de ces regles releve de la responsabilite des Etats. Notre contribution vise a analyser l’etat present de la mise en œuvre de ces mesures dans l’outre-mer francais afin de determiner le role et les pouvoirs des communautes autochtones et locales de la Republique dans le cadre de l’acces et l’utilisation des ressources genetiques et des savoirs traditionnels associes. English Abstract: Due to developments in the field of biotechnology, research activities on biodiversity and more particularly on genetic resources have increased. The development of these activities has led to the adoption of new rules at the international in the field of access to genetic resources and benefit sharing. These measures involve indigenous and local communities as providers of resources and of traditional knowledge associated to it. States are responsible for the implementation of these rules. This study targets to analyze the present state of these measures in the French territories abroad in order to define the role and the powers of local and indigenous communities from France.
