Abstract
Certain countries have considered to condition for reciprocity the foreign investment released to the countries from where the foreign investment came from. Such situation might be discriminatory and violates international law. While it is true, the countries may restrict foreign investment. These restrictions must be made a priori, consistent with the other principles contained in the treaties and granted or restricted in an identical manner to all the partners of the country that restricts. Therefore, taking as regards the North American free trade agreement (NAFTA), United States, Canada and Mexico could liberate foreign investment, but cannot ask for reciprocity, thus it can mean discrimination between the parties and violation of the principles of international law.
