Abstract
Many elements of the Canadian government’s proposed anti-terrorism package undermine privacy by allowing for the increased collection, storage, aggregation, sharing and linking of information without adequate accountability. However, some of these provisions that undermine privacy are in fact difficult to question in constitutional terms. This is because our current constitutional thinking regarding privacy is not able to articulate the nature of an individual’s privacy interest in the face of widespread, expected surveillance. Moreover, new technologies facilitate the erosion of privacy through the cumulative effect of what are often minor privacy infractions. Assessing these technologies, and the provisions that facilitate and authorize their use, therefore requires attention to the collective effect of surveillance in the post-September 11 world. For this, we need new tools of analysis.
