Abstract
Le silence d’une personne peut faire l’objet de multiples interprétations. L’histoire du procès pénal français en est une illustration. Parfois interprété comme un aveu, le silence du mis en cause au cours de la phase préparatoire du procès pénal a longtemps été rejeté par les autorités pénales françaises. Il a même été régulièrement la source de certaines dérives de leur part. Cependant, il est aujourd’hui toléré, notamment au nom de la dignité humaine. Le droit positif reconnaît même un droit au silence au mis en cause. Toutefois, ce droit est loin d’être absolu à l’heure actuelle. Sa reconnaissance a été hésitante et sa portée reste encore limitée. Quelques évolutions paraissent dès lors nécessaires.
