Abstract
Das deutsche Arbeitsrecht enthält Regelungen über Mindeststandards, die nicht zuletzt einer Unterbindung transnationaler Lohnkonkurrenz dienen sollen. Einige dieser Regelungen (ArbZG, AÜG, AVE-Tarifnormen) können jedoch durch tarifliche Regelungen unterboten werden. Von anderen Regelungen (AEntG, MiArbG) wird behauptet, die Zulassung ihrer tariflichen Unterbietung sei verfassungsrechtlich geboten. Aufgrund der Laval-Entscheidung des EuGH muss jedoch jede Möglichkeit zur tariflichen Unterbietung auch U-ausländischen Tarifverträgen eröffnet werden. Das Gutachten analysiert zunächst kritisch diesen wenig beachteten Aspekt der Laval-Entscheidung. Anschließend werden ihre rechtlichen Auswirken im deutschen Arbeitsrecht aufgezeigt. Im dritten Teil werden rechtliche Möglichkeiten diskutiert, im Gegenzug zur Gleichbehandlung den Inhalt EU-ausländischer Tarifverträge oder die Tariffähigkeit EU-ausländischer Gewerkschaften zu kontrollieren. Beide Ansätze erweisen sich als allenfalls eingeschränkt tauglich. Am Schluss werden Empfehlungen für staatliche und gewerkschaftliche Politik skizziert.
